Police Complaint Commissioner to Appeal Court Ruling Favouring VPD Officers

The Office of the Police Complaint Commissioner filed an appeal Friday of a ruling last month cancelling a public inquiry into the mistaken arrest two years ago.

On Jan. 26, B.C. Supreme Court ruled that the commissioner did not have the power to hold a public inquiry into allegations of excessive force  by two  VPD constables when they mistakenly arrested Yao Wei Wu on Jan. 21, 2010.

Deputy Commissioner Rollie Woods told me at the time that the ruling could severely impact the way the office handled future cases. And he said he was surprised by it because he believed the commissioner had the power to call inquiries whenever he felt they were warranted.

As has been widely reported, Wu sustained serious injuries when police tried to arrest him on a domestic abuse complaint. But the call had actually come from his basement suite and did not involve him at all. He suffered a broken orbital bone, cuts and bruises and is suing the VPD.
